High Energy Solar Referral Program

This Maxeon Energy Solar Referral Terms and Conditions Agreement is made by and between Maxeon Energy Solar LLC. and you, as an Affiliate individual or group utilizing the maxeonenergy.com service(s), to provide the best products and services at the highest quality level. To participate in the program, you must agree to abide by the terms and conditions contained in this agreement. Please read this agreement carefully before submitting referrals. By submitting referrals, you indicate your acceptance of this agreement and its terms and conditions. If you do not submit referrals, you will not be a part of the affiliate referral program and will not be paid for your referrals.

 

This agreement is summarized as follows:

• You must be 18 years of age to participate in this program.

• Applicants must be United States citizens.

• Maxeon Energy Solar may contact you via email if we notice any missing or incorrect contact information.

• You will receive a $1,000 bonus if and when your referral's solar energy system is installed and operational and logged as such in our sales system. You must submit a W9 prior to receiving payment.

• Affiliates outside the United States must include their social security number in addition to their address on their applications.

• If you will be receiving checks, be sure to use your actual address. The use of mail forwarding services for the purpose of avoiding demographic surveys is strictly prohibited.

• This agreement does not hold Maxeon Energy Solar liable for any damages.

• You will be required to pay taxes on any incentives, commissions, payouts, or checks you receive from Maxeon Energy Solar. We will give you a W-9 form.

• Spam is not allowed. High Energy Solar will terminate your account if you are caught spamming. Do not send bulk e-mails to people who have not explicitly opted in to receive communication from you.

• We ask that you do not publicize our offer in any way, using banners or links within your newsletters, blogs, in the content of your website, or within other web-related content such as social networking sites and alike.

• We reward first-hand referrals with special incentives. We will honor the first member who submits a referral. Duplicates will be handled as follows: The first person that submits the referral, based on the time stamp in our system, will receive credit for the sale and receive the referral. This also applies to referrals that are already logged in our system or are customers of Maxeon Energy Solar. Each referral must be generated outside the efforts of Maxeon Energy Solar.

• Our system will not accept your referral if you enter an incorrect email address. We are not responsible for any errors in the member registration form you submit.

• Failure to abide by these rules could lead to termination from the affiliate program and forfeiture of all payout.

Definitions:

Payout

​

Payout means the total commission percentage a merchant pays for individual, measurable actions. In this case, the payout is up to $1000 per referral provided by you, which results in the sale of a solar electric system (residential or commercial).

Affiliate Payment

Referral leads will receive payouts if they result in contracted installations. Payments will be made following the installation and commissioning of the solar system.

Maxeon Energy Solar will provide support for the Service as described on its websites and in its Terms of Service.

Maxeon Energy Solar reserves the right to send you emails regarding changes or additions to its affiliate referral program.

Changes to the Service

​

Maxeon Energy Solar

reserves the right to make changes to this Agreement. When any material change is made, Maxeon Energy Solar will notify you via e-mail, newsletter, or the Maxeon Energy Solar website at least 7 days prior to any such changes taking effect, and you may either agree to such changes or withdraw from the Service.

Participation

You must be at least 18 years old and provide a valid tax-id number. You will need to fill out a W-9 prior to receiving payment.

Accepted Usage

You represent to Maxeon Energy Solar, LLC that all content You provide to the Service is solely owned by You or provided by You with the express authority of the person or company You represent, does not infringe upon any other individual’s or organization’s rights (including, without limitation, intellectual property rights) and is not defamatory, libelous, unlawful or otherwise objectionable. You shall not provide, promote, distribute, place or otherwise publish as an Affiliate of the Service any content that is libelous, defamatory, obscene, pornographic, abusive, fraudulent, or violates any law. As Maxeon Energy Solar may not review all information provided by You and/or Your Web site(s), You shall remain solely responsible for Your Content and Site(s). If you are terminated from the program, Maxeon Energy Solar reserves the right to withhold already paid commissions and to bar you from participating in the Maxeon Energy Solar affiliate referral program.
